What is a Lasting Power of Attorney (LPA)?
The Gov.uk website says that a lasting power of attorney is a legal document that lets you (the ‘donor’) appoint one or more people (known as ‘attorneys’) to help you make decisions or to make decisions on your behalf. This gives you more control over what happens to you if you have an accident or an illness and cannot make your own decisions (you ‘lack mental capacity’). There are two types: health and welfare and property and affairs. You can have one or both, but not a mix, like property and welfare only.
Do I need a solicitor to get a LPA in place?
No, you don't need a solicitor to make a simple Power of Attorney, you can do this yourself, but the process can be pretty complex and mistakes can not already be rectified after the person has lost capacity, and it can cost several thousands of pounds to fix any errors after. We offer a free checking and support service for a fraction of the cost of using lawyers, and we can certify your application too, at no extra cost. Whilst our principal social worker Gary Spencer-Humphrey has a few law degrees, he is not a practising lawyer, so if your case is complex, or not straightforward, we work with great solicitors in the local area and would be happy to link you up (with your permission). For your added peace of mind, we receive no referral fees for this, so we only recommend high-quality, caring and passionate solicitors and those we have worked with for years.
We can certify (called Certificate Provider) in three simple steps.
1. Instruct us (which means you ask us formally to act for you). This includes a meeting with you (and your family if you like), and where required, a capacity deceleration will be done to show you have the mental capacity to make the LPoA.
2. We review the LPoA free of charge (included in the certificate provider fee)
3. Receive the pack completed and ready to register (we'll even register it for you)
Our Certificate Provider and/or Witness, fees start at £125 ( no VAT applies), so what you see is what you pay. If you would like us to register your LPoA, we just ask for an additional £10 administrative (to cover postage and our process time in addition to the registration fee charged by the Office of the Public Guardian - currently £82 as of 01/02/2023. If you are on means-tested state benefits, you may be entitled to an exemption or remission of the fees; please see here.
